Terms and Conditions

1. Conclusion of contract

1.1 Validity of the General Terms and Conditions

These general terms and conditions (GTC) apply to all contracts between Sarah Benzarti and her customers, unless otherwise agreed in individual cases. Customers are all those people who acquire or have acquired the right to use the courses and events offered by the company within the meaning of Section 2 (customers).

1.2 Conclusion of contract and booking

Contracts between the company and the customers are concluded through offer and acceptance within the meaning of Sections 145 ff. BGB. Registration for or booking of courses, workshops, or other services and events (events) offered by the company represents a binding offer by the customer to conclude a corresponding contract within the meaning of Section 145 of the German Civil Code (BGB), whereby the registration/booking can be done by email, letter, telephone, online or on-site registration form, as well as via the Fitogramm sports market platform. Acceptance by the company takes place by sending a registration or payment confirmation by email (if necessary by means of a fitogram) or by signing the contract. Participation in booked events is excluded before the full invoice amount has been paid, unless otherwise agreed. The confirmation of a place in a workshop only becomes binding once the respective fees have been paid in full.

2. Course and event offerings

2.1 Implementation of the offers

The courses and events are offered online or in rooms rented specifically for this purpose.

2.2 Opening times and changes to the range of courses and events

The office and course times, as well as the current course and event offerings, are published and continually updated on the company's website (www.sarahmilacoaching.com) and on social media (Instagram, @sarah.mila_coaching). The company also reserves the right to make necessary changes with regard to the opening times, the courses and events offered, and the teachers of the respective courses. Corresponding changes will be announced via the website www.sarahmilacoaching.com, social media and via newsletter. In this case, the company will find an appropriate alternative in consultation with the affected customers. Fees that have already been paid will be charged in the event of a replacement booking. If an alternative date is not desired by the affected customers, the fees paid will be refunded.

 

2.3 Monthly and points cards; Single tickets

To book the courses offered, the company offers monthly and points cards, as well as individual tickets, which entitle you to book and participate. Monthly tickets are valid for a period of 31 days from the time of first use to book the courses offered during this period. Points cards are available as cards of 10 for booking individual courses between 15 and 90 minutes. Individual courses can be booked using individual tickets. Monthly and points cards cannot be used to book workshops, training and further education events or retreats. Monthly and points cards are generally personalized, valid for one person at a time and are not transferable to third parties. For both monthly and points cards, transferability is possible in individual cases for special reasons (pregnancy, moving, permanent illness or injury) after prior consultation with the company. 
From the time of the first participation booked with a monthly or points card, monthly cards and points accounts are valid for one (1) month. Paid monthly and annual passes expire after the expiration date. A refund of paid fees is excluded. The period of validity of monthly and points cards can be extended in special exceptional cases.

2.4 Other offers

Other services such as massages are offered in various lengths and forms. They are intended for relaxation without any therapeutic claim. Unless otherwise agreed, a cancellation period of 48 hours applies. The specified amount for the particular session must be paid at the end of the session (cash, PayPal, bank transfer). Unless otherwise agreed, the full amount of the session will be charged for cancellations at short notice of up to 47 hours.

3. Prices, payment terms, offsetting

3.1 Price lists

Prices and fees, as well as information and details for booking the course, program, coaching and event offer can be found in the company's current price list, which can be viewed on the website www.sarahmilacoaching.com or has been exchanged by the company via newsletter, social media or private correspondence.

 

3.2 Due date of fees

Unless otherwise agreed, participation fees and fees are due immediately upon conclusion of the contract.

 

3.3 Payment

Payment of the invoiced participation prices or fees can be made by bank transfer to the company's account stated on the invoice, using a voucher or in cash on site. In the case of an online booking, payment is possible using online payment systems (e.g. PayPal, instant transfer, etc.) or by credit card.

3.4 Discounts and Promotions

Discounts, promotions or other promotional offers are limited to the specified period of validity. Advertising vouchers will only be accepted if the original is submitted. A combination of several discounts from different advertising or special offers as part of one booking is excluded.

 

3.5 Offsetting

The customer only has the right to offset if his counterclaims have been legally established, recognized or are undisputed by the company.

4. Non-participation; Termination

4.1 Cancellation, failure, non-participation

Please note that in the event of cancellation, failure or otherwise non-participation in booked events, particularly with regard to training or further education including training parts, a claim to a refund of the participation fee or the event fee or parts thereof is excluded. A certificate of participation or completion will not be issued for training or further education courses that have begun but have not been fully attended in the above sense.

4.2 Cancellation deadlines, statutory termination and withdrawal rights

a. Booked classes can be canceled 24 hours before the start of the class with a full refund.

b. Booked personal training & Coaching or Massage sessions must be canceled 48 hours before the start of the appointment. Otherwise there is no refund for the booked appointment.

c. There is no possibility of refund or cancellation when purchasing workshops. There is no distance selling contract within the meaning of Section 312 g Paragraph 2 No. 9 BGB. However, if you are unable to attend the workshop, you can find a replacement person to attend in your place, provided you let us know by email at sarah.mila.benzarti@gmail.com.

d. It is not possible to cancel or receive a refund for online programs that have already been purchased and received. 

5. Liability 

5.1

The company, its legal representatives or vicarious agents are only liable for damages if the damage is due to gross negligence or intent; or was caused by culpable violation of an essential contractual obligation (cardinal obligation), i.e. an obligation whose fulfillment enables the proper execution of the contract or whose violation endangers the achievement of the purpose of the contract and on whose compliance the contractual partner can therefore regularly rely.

 

5.2

Furthermore, the company’s liability for damages – regardless of the legal basis – is excluded.

 

5.3

If the Company is liable in accordance with Section 5.1(b) for the breach of an essential contractual obligation without there being gross negligence or intent, the liability is limited to the extent of damage that the Company typically expects to arise when the contract is concluded based on the circumstances known to it at that time had to.

 

5.4

The above limitations or exclusions of liability do not apply in the event of culpable injury to life, body or health, for liability claims under the Product Liability Act or in the case of a contractually agreed liability regardless of fault.

5.5

Participation in the courses and events on offer should only take place if the customer is in full health. In its own interest, the company recommends that its customers discuss their intention to participate with a doctor before taking part in the company's events, especially if they have specific health problems such as physical ailments, previous operations, problems during pregnancy, etc. and when registering and in the event When taking part in an event, inform the teacher or speaker of any existing health restrictions before the event begins.

6. Copyrights

6.1

The content and works on these pages created by the site operators are subject to German copyright law. Reproduction, processing, distribution and any kind of exploitation outside the limits of copyright law require the written consent of the respective author or creator. Downloads and copies of this site are for private, non-commercial use only

permitted.

 

6.2

If the content on this site was not created by the operator, the copyrights of third parties are respected. In particular contents of third parties are marked as such. Should you nevertheless become aware of a copyright infringement, we ask that you notify us accordingly. If we become aware of any legal violations, we will immediately remove such content.

6.3

The course participants give their consent that photos or film recordings taken during the courses may be used in audiovisual or print media without compensation and for an unlimited period of time and space.

7. Data collection

The company collects, transmits, processes and stores the personal data relating to the respective contracts to the extent and for as long as this is necessary for the justification, execution and processing of the conclusion of the contract and the company is obliged to store this data due to legal regulations.
